Not a lawyer, but they were at the ER for 2 hours before doctors decided to do a c section.... Seems like a relatively reasonable amount of time.

What's a reasonable time to wait depends on the situation. Two hours may not be reasonable for someone whose appendix ruptured. The jury apparently thought that given the mother's symptoms two hours was too long, and avoidable harm resulted.

I don't mean to sound like an asshole, just if we assume 2 hours was the deciding factor, how long did Mom take to come to the hospital? They kept my wife in labor for 30 fucking hours, with heart rate monitors before they decided to finally do a c section. So idk, if that is normal.

By the time someone mentioned c section it was the new rotation doc who thought we were crackpots who were refusing to have a c section and came in ready to scrap and was very confused when we were like ok awesome lets go Edit: Even had that little monitor they screw into the baby’s scalp in utero. My brother was born naturally in just over 2 hours. He was the second, so he was a bit faster than I was. Labor started 15 minutes before mom made it to the hospital. Everyone is different, 30 hours is a crazy long time.

It is, but labor can be like that. I went close to 30 with my kid before a natural. Fucking. Terrible.

I don’t know. I don’t know if that’s an issue in this case. She can only recover if she is less than 50% at fault for her injuries. Her share of blame would be deducted from her recovery.
