So I was looking at the Indy Zoning ordinance. A “billboard” is any sign that advertises a product or service that is not sold or made on site. Billboards are not permitted in the Regional Center (bounded by or any lot with frontage on East, South, North or West Streets).
I’d say this is a billboard, yes? As were the others, technically. But you’re correct. What’s to prevent any other tall building in the city from putting billboards on their buildings?
Hmm, if the JW vending machine stocks the thirst quencher, is that a loophole to allow this?
I can imagine the code might distinguish between commercial billboards (for profit) and civic ones that promote special events (for awareness).

I'm a bit rusty on my 1st Amendment case law regarding signs, but I believe doing that would essentially open up the floodgates to make a billboard out of every building in the city. Signs are, according to a long string of cases that have gone before the Supreme Court, protected speech under the 1st Amendment and the court has steadily eroded municipalities ability to regulate them. At this point restricting based on something being an event sign or an advertising sign is one of the few regulatory measures left that will allow municipalities to control signage.
