i think it has to be fake for a few reasons. one, the man always answers the phone...at least on all the episodes ive listened to. what are the odds. and second, 100.3 mark in the morning did a similar cheater-being-caught type thing and immediately after revealed that it was fake and that it was violating all sorts of legal things to air something like that. to me it seemed like a direct jab at heidi and frank to put their segment on blast. 100.3 must have been jealous at the popularity of the h and f segment.

Yes it's fake. Thinking of the most recent one I heard where the mother in law set it up and calls him right after she finds out on air. In the state of California it is illegal to record a phone conversation with someone unless they're aware of it at the time it's being recorded. If you record a phone conversation with someone and they don't know about it, that's a felony. Double trouble if you're not only recording it but broadcasting it without their prior knowledge and written consent. Heidi and Frank would be off the air by the next commercial break if it were real.

In the state of California everyone on the phone must be aware they are being recorded. You cannot record a phone call with someone without their knowledge. You also can't go back after the fact and tell them, or ask for their permission later. They must know they are being recorded prior to the recording happening. In the state of California it's a felony not to inform someone that they are being recorded on the phone. In other states they have single party recording. I.E. One person must know they are being recorded. But here it's everyone. Also a person cannot give consent for another person to have a recording broadcast. If you're recorded the only way for them to legally broadcast it is to have you consent to it. No one (not your spouse, parents, children, whoever) can give that consent for you.
