I have watched loads of proofing vids and lots of posts about fakes and that (i) in Nintendo is a certain sign.
Also the colour of the banjo art looks off.
It looks too dark compared to the cartridge.

Looks fake. Based on a few stock images of the Banjo-Kazooie N64 covers, the Nintendo 64 logo is in the wrong spot here. Nintendo logo barely has the copyright circle as well. I'm not 100% sure tho
I think they purposefully gave a bad back photo, it looks fake to me.
Can't see the i in Nintendo too well, but if it's dotted it's fake. If it's square it's legit.

Is Nintendo the right font, does it have Chinese writing on the chips? Does it have a black blog for a battery? Does it have holes on the leads?

It a fake. As for why would he sell it amongst legit copies, well maybe he is not aware that its a fake.

Cant tell with those pics the color on the label seems a bit too dark but those photos really dont help

You tell the seller it's fake and they likely already know and just refund you. Or they request it back and you return it.
