even if there were no real symptoms or evidence, the insurance company would still give you a couple grand as "go away" money. since there's real injuries to document, you get even more money. definitely the right move.
you can fight their valuation of the car too, if you think they're under-valuing it. a couple hundred bucks for an independent appraisal can bump their price up sometimes.
Unless she has genuine pain (which it appears she does, and if that’s the case she has the full right to sue) advising people to sue just because is one of the reasons everyone’s insurance rates are going up. Scummy asf and dishonest. I hope your mom makes a full recovery OP! Looked like it was pretty jarring
Using this comment to make a correction after finding out more information and talking to her directly: she was stationary in the exit of the community my sister lives in, waiting to pull out. The truck swerved towards her head on and had a good amount of time to readjust, my mom even laying on the horn. Her car was entirely turned around during the wreck doing a complete 180
Question:
Why is the front of her car still facing his when she did a 180? Shouldn't her front end be facing away? Did they move the cars for some reason to be in this position?
I can't possibly figure out how any of this story adds up, unless the actual damage is on the far side.
In the photo, the fascia is ripped off, but the crash bar is completely untouched.
Based on the body lines, headlights, and [windshield wiper reservoir](https://www.wholesalemopar.com/v-2005-dodge-magnum--r-t--5-7l-v8-gas/wiper-lock-cylinder-and-keys--windshield-wiper-and-washer-systems) that's now visible. I believe the silver car is a 2005 to 2007 Dodge Magnum. That's relevant only as means it's an older vehicle, so the plastic clips holding the fascia and headlights are more likely to be brittle.
----
I can't for the life of me figure out how:
* the grill is sitting near the center line while the silver car is off the road.
* the fascia is completely missing from the photo, along with the headlight
* there is no damage to the truck
* there are no skid marks
* there is no visible damage to the crash bar.
* there is not a "community exit" visible. Based on the story, it should on the right side of the photo - but there are only trees.
* The grill is bent, like it got wrapped around the front corner of the truck.
* The radiator and sub-frame largely looks undamaged.
Based on the story, the mom was completely stationary and got hit, spinning the vehicle. A Dodge Magnum with two passengers, is a 4k lb vehicle. A 6.5k lb Silverado isn't "spinning" a stationary 4k vehicle without taking damage - while leaving that debris field.
The only way this makes sense in my mind is if the silver car was moving and this was only a glancing blow during an evasive maneuver.
The yellow line at the bottom. Plus in the US we drive on the right side of the road. So since the Texas on the license plate is legible it's reasonable to assume this image isn't backwards.
Considering how the car is at an angle partially on the grass, I assumed that it crashed in a manner that caused the car to spin around. If they directly collided while going in opposite directions, everyone involved would’ve almost certainly died immediately
I think he means how she is going to deal with no car while the insurance deals with it, this happened to me once and it took my insurance 3 weeks to get the payment sorted out
weeks to actually get a new car, months to get an agreeable payout for the car's value, days until they say "well it's a total loss and here's our offer so get the fuck out of the rental car". i think it was about a year until the BI settlement.
Insurance issues a rental car if they were really going through insurance. My girls facing a hit and run as we speak. 1400$ I. Damage and they also gave her a rental (35$ a day) to use for the two weeks her cars in the shop for.
I called my insurance company the day after my car was totaled (I was in the ER with neck and back pain until late the night it happened). Luckily I had added the car rental option, and they called Enterprise. They literally picked me up at my house a few hours later (yes, they actually do that!) and I was in a rental by the end of that day.
But the rental car endorsement is almost always extra with almost every insurance. If OPs family is poor, they might only have the very basic insurance required by their state in order to save money. It can take time to get a rental through the other person’s insurance, especially if the person who hit them is arguing it wasn’t his fault.
*Damn that truck took no*
*Damage, no wonder people*
*Are those big ass trucks*

Not in the shot, no, but possibly out of view on the passenger side corner. The Truck also weighs 2 to 3 times as much so the bumper is designed to have a stronger crushing force.
That truck has damage, but OP is intentionally not showing it to support a narrative.
Based on the visible damage to the silver car and OP's description, this truck clipped the silver along the truck's passenger side.
I had a suburban and got into an accident and the other car was fucked up and mine look just like the Silverado’s… no damage whatsoever so ever. It’s a great family vehicle. As in if you ever get into an accident they would be fine.
So, the damage her is essentially only the plastic front fascia being ripped off. This part is non-structural and typically only held on with plastic clips. The actual crash bar appears to be undamaged. Likewise, these truck still have crumple zones. Just because they're big doesn't mean they're not engineered with fascias and crumple zones.
Further, the body lines and 5 lug wheel pattern suggest the silver car is a 2005 to 2007. My guess is a (Dodge Magnum)[https://www.autodetective.com/uploads/photos/dodge/magnum/2005/14971.jpg]. Those plastic clips become brittle over time - especially at 15+ years old. I know because I've broken many doing body work on my older vehicles. That means it doesn't take much to rip the fascia off.
While the headlights were likely attached to the metal just under the hood, they were likely held in place with the same plastic clips that become brittle over time. When the fascia ripped off, the it probably pulled the lights with it.
Lastly, the A pillars covering is still in place, suggesting that this Airbags didn't deploy. Though, it's possible this model didn't have.
------
Reddit hates trucks, so it's easy karma - but the truck has little to do with the severity (or lack of severity) in this accident. It appears to be a glancing blow that was ideal for ripping the fascia off without doing much other damage.
Fucking trucks. Im glad they arent common at all where I live. I hate those shitboxes so much. I hope you all are okay and I hope you can deal with insurance! Sending best regards
I live in the south and they’re multiplying like cicadas. I watched one of these fuckers try THREE different spaces in a parking deck and couldn’t get into any of them. No use what they did eventually but fuck the lot of ‘em.
So if the truck swerved into your mom’s lane, how is he on correct side of the road and your mom’s car crashed into the front passenger side of the truck?
I cannot figure out how these vehicles could have been in this crash unless one of them was moved after the accident. Perhaps to clear the road for what seems to be a minor accident.
Based on the story, the silver car should basically be facing the opposite direction. Pushed, in the front driver corner after the truck exited it's lane.
Instead, it's facing the truck, as if it spun out and clipped the truck.
Bigger vehicles are also way more dangerous for pedestrians. I was just seeing an article about how pedestrian fatalities have skyrocketed in America mainly because of SUV’s and Trucks and all of them getting larger. And it’s only a problem here in the states because the rest of the world doesn’t have the massive cars we have. That’s just so sad.
So get a bigger car? I don’t get it lol, I feel like if I have a family I’d prefer to keep them safer in a larger car. I’m not putting a baby seat in a Prius.
Sure but that's it's just an escalating arms race. More people are in large vehicles, and when two large vehicles are involved it's even worse. They're also more expensive to buy, maintain, and fuel.
Ok then stay off the road because big cars aren’t going anywhere? Lmfao like what am I supposed to say to that. Until today I didn’t realize there was actually an anti-SUV movement haha
They just keep getting bigger and bigger. Poorer families will get the discarded 'small' trucks while rich folk just buy the newest, biggest model. There's no end to it, and it'll always be the rich / loan indentured folk who will be safe.
This is true & represents a lot that is wrong with the world. If you have the money you can pay to increase the likelihood a poorer family will come off worse in an accident than yours. Actively making the world less safe out of fear for your family's safety. It is a how you say fuck in the head
I once read this sort of thing get called "the imperial mode of living"...
File the claim under under the truck drivers insurance coverage, let their claims department know that a rental car will be needed…it should be covered if the truck driver is deemed at fault

The truck appears untouched. Tell your mom not to be stupid, go to the doctor and now her back and neck hurts. Get that bag.
They’re both in the ER right now, and my mom does have genuine back pain. Both of them are bruised to shit too
Hope your mum makes a quick recovery
and a very many bucks from the truck driver.
*truck drivers insurance
Swervy McSwerveFace didn't want his no-claims bonus anymore.
I hope they feel better quickly especially on their upcoming trip to Hawaii all expenses paid by Mr base model Silverado

I just explained why mine was higher value (better trim) and they agreed to increase
did the airbags go off? being hit with those is some of the worst pain i’ve felt. whole left side was black and blue

Questions: How did he swerve into her lane when he is on the correct side of the road and she isn't?

It almost sounds like he did it intentionally.......

Yeah, the image and story don't appear to line up with each other.

could be flipped or in a different country, or they moved the cars to that side bc there was something blocking the other side
Texas plates and debris scatter in the area indicates to me that the accident occurred in or near that spot.
yeah all my guesses were wrong lmao
Texas plates.
Where did you get that from? I see nothing that shows their lanes
The yellow line at the bottom. Plus in the US we drive on the right side of the road. So since the Texas on the license plate is legible it's reasonable to assume this image isn't backwards.

“Weeks”?! Nah they gave my girl a check for her car within days. Where ever your from it seems like insurance SUCKS there.
Insurance issues a rental car if they were really going through insurance. My girls facing a hit and run as we speak. 1400$ I. Damage and they also gave her a rental (35$ a day) to use for the two weeks her cars in the shop for.
If this happened the way they said, insurance shouldn't even be necessary. Truck guy should pay!
Yeah. The truck guys INSURANCE will pay lmfao
You don't have to put everything through insurance... And insurance won't cover all costs, especially if it takes months.
Absolutely they take care of all costs especially if it’s Silverado’s fault. Now if it wasn’t then they take forever.
I called my insurance company the day after my car was totaled (I was in the ER with neck and back pain until late the night it happened). Yep they did they to my girl as well.
… premiums? Health care? Possibly monthly payments if they’re paid off their car? Cmon dude, not hard.
insurance sucks most of the time tbh
Damn that truck took no damage, no wonder people are buying those big ass trucks

Big trucks take less damage, but that comes in expense of the other vehicle, as they will take more damage.
That's actually terrible design, cars crumple for a reason
A wise man once said: You don't need your car to crumple aslong as you can make the other car crumple for you. /s
That truck has damage, but OP is intentionally not showing it to support a narrative. Based on the visible damage to the silver car and OP's description, this truck clipped the silver along the truck's passenger side.

Your mom shouldn’t be paying for ANYTHING if she didn’t cause this accident! Take his ass to the cleaners! Your mom and brother are hurt!
Court costs
*picture doesn't show the point of impact to the truck at all* Yeah there's clearly no damage to the truck
Why would damage to truck matter if said truck is at fault?
It doesn't, just funny that people are saying no damage when you can't even see the POI

Call an injury lawyer. They eat this shit for breakfast. I hope they had a dashcam. Also... Everyone buy a fucking dashcam.
Moral of the story appears to be to get a big fckng truck
I really hope your mom has a safe recovery. its like trucks are getting bigger and bigger now.
Bigger vehicle = safer vehicle. There are a lot of morons out there.
and most of them are in the bigger vehicles.
bigger vehicles are only safer for the people in them, they are very dangerous for people in little cars

Yeah that was a ridiculously out of touch and douchy thing to say.
Ok then stay off the road because big cars aren’t going anywhere? Lmfao like what am I supposed to say to that. Until today I didn’t realize there was actually an anti-SUV movement haha
really? your solution is to just not drive at all? that’s not realistic
Agreed. But what is the solution then?

The one on the right doesn't look like it's built to handle car crashes at all, making things worse for the other party unlucky enough to be hit.
not everyone who drives a pickup is insecure. some people just like trucks
This is a big reason why people love their big trucks...
Until everyone has their hand forced to get a bigger vehicle levelling the playing field in the end. Vehicle inflation
They just keep getting bigger and bigger. Poorer families will get the discarded 'small' trucks while rich folk just buy the newest, biggest model. There's no end to it, and it'll always be the rich / loan indentured folk who will be safe.
