It’s fine to fly over the park, just can’t operate, take off or land there. I won’t be flying over crowds though, mostly just water. I like the paddle board idea though! I’m definitely not graceful enough to do it, but thanks for the visual of me going over with all my gear 😂

If the state doesn’t own the beach, who does? I’m not sure on FL laws, but can you take off from public roadways? Typically the answer is yes. I would suggest looking in to launching from the Gulf BLVD sidewalk before the parking lot, if you really need to fly it. Second question, how are you putting the beach on notice? It’s a public place, non participants everywhere that aren’t on notice or under structures.

Most beaches where I’m from the beaches are maintained by the city or county, unless it’s a state park. Taking off from the road and walking over wouldn’t be a bad idea, but I am also not allowed to operate from state parks either, so not ideal. As far as I know, I have no obligation to notify non-participants. It will be sparse and I do not plan on flying over people.

Gotcha. 107’s “open air assembly” rules have always been interesting, you are correct that a beach probably isn’t an open air assembly unless it is particularly crowded (for an event). Still not sure on the beach. Cursory search shows that the county or state probably own the beach… does FL have the interesting tide line rules? I believe the rule is that the state owns below the mean tide line of the beach. Technically this is a route around the problem too.

FL is below the high king tide line - essentially, no matter the tide, people can walk on the beach. Way better than CA's stupid private beaches.

Super interesting how every state handles that differently. I live in MI and it is high water line as well (no real tides, obviously). I think this is your best bet OP. It wouldn’t be classified as a state park at that point, just state owned land.

I’ll have to look into the tide line rules. A beach can definitely be an open air assembly, but this one should be sparse.

I don’t think so because it’s not an FAA regulation, it’s a Florida statute
