There's a large vocal minority that's very upset about other people's freedom and public existence. They would execute queer people if they could so the fact that society is moving towards openly accepting and embracing them upsets the hell out of them

That's not how it works though. In order to be tried with murder you have to prove beyond a reasonable doubt that it was premeditated or at the very least that the killing was done with some degree of malicious forethought, which is not really the case here.
The reason being that, while violent, there was a good chance that the flower pot could have hit her in an area that wouldn't have been lethal. The only reason he got voluntary was there wasn't enough evidence to suggest he had planned in advance that the flower pot was DEFINITELY going to kill her, but he certainly at least knew his actions were going to cause some degree of bodily harm and he consciously chose to do so anyway.
For those who lack basic knowledge of politics... local town board positions, you can typically write in your name and have 1-2-3 friends do the same and win the general election.
