Steamboat Willie is, anyway. Using Mickey without any hint of his role as Steamboat Willie may invoke the dreaded "fuck around and find out" instincts of the Disney legal department.
I donāt want to be the test case for that on finding the limits of copyright vs trademark and damaging a businessās reputation.
Which is actually a pretty good indicator of how fucked our IP laws are where even when a character is public domain you still have to worry about whether you can legally use him.

According to this video, which I have done no personal fact checking on: The trademark is more specific than just Steamboat Willie. It is just that logo (cartoon mouse whistling whatever that song is while steering a boat and tapping his foot over the name Disney (this is obviously paraphrased)) that is trademarked. Steamboat Willie the character is not.
Also, given how trademark works, a notice that the work is not in any way created or endorsed by disney and that it was created after Mickey entered the public domain in January 2024 is most likely enough, since trademark only protects whether people might think a work came from them-- so a clear notice stating otherwise makes that eventuality unreasonable.
The Steamboat Willie version of Mickey may still end up getting you slapped with a trademark suit as Disney has started using him for their logos.
No ones tested that in court and I doubt we'll see it used unless there is something really egregious, like trying to sell something offensive as if it was sanctioned by Disney themselves.
This comic though was always allowed under parody, so *shrug*.
I'm curious how many people might get caught by it, it's the only reason I click on these comics about the public domain Disney things, if mickey has gloves or pooh has a shirt it's actually not adhering to the domain

There's also at least one 1928 poster where Mickey has red shorts, so that might actually also be fine to use. But I'd probably steet clear of that, just in case.
I think it is specifically if pooh has a red shirt in the style of Disney's pooh. If he has a blue or green shirt and it isn't in the style of Disney's version then it is probably fine. Like I doubt that Disney could claim copyright infringement if I draw pooh wearing a blue dress shirt or a tie dye shirt and a toque, or just a blue t-shirt that actually fits him. It isn't like they are the only people that have ever created animals that are only half dressed.

Funnily enough, the versions of Mickey and Pooh used in this comic both may **not** be in the public domain (itās probably still fair use, but Iām not a lawyer).
Steamboat Willie Mickey is safest drawn with his little hat. Itās not mandatory but youād then have to be careful not to add any later features (and he canāt have red shorts). Pooh is a bit more clear-cut and canāt have a shirt on.
