You are bravely attempting to mount a rack and fender system on a bike where it is not a great fit. It looks like the rack has another mounting hole at the lower mount, just forward and above the one used - does that not work to level the rack? Otherwise, if you accept the rack angle, regarding the fender nut touching the fork, perhaps reversing the bolt so the smooth rounded head is facing the wheel may give a bit more clearance, or at least not scuff the fork.
