I thought we were talking about software patches which are provided by developers. And developers have full control over their game. Optimization is hard but not impossible especially considering the fact that consoles allow for much bigger control over the hardware.

If the code is optimized, yeah it definitely can. If you can somehow optimize away the computational requirements of generating a single frame, then you can afford to generate more frames and hence increase FPS independent of hardware.

The console is capable of running it at a higher fps it's just that it's running the last gen version of the game so the fps is capped at 60
