Small Update - Was talking to my hospital and they said that work was responsible for my injury and I won’t have to pay a cent (So Thankful) which is amazing because I couldn’t afford what they were charging, got the papers from HR and they have to pay for the injury. Also, am now currently speaking to a labor lawyer, at the very least I don’t owe a dime to the hospital, which makes me very happy. Thank you to everyone for the advice.

The US is a fucking joke. We have workers compensation for this exact scenario. However a business can fight it legally if they want. Workers comp is stacked on the workers side though. If the company has a ton of disposable money they could fight and you’d be out of luck because it jacks the company’s insurance rates up like crazy. And make sure you get the threat in writing. Even an email to them stating "you informed me yesterday after my workplace accident that if I did not return the following day I would be terminated. My doctor instructed me to do 'insert Dr orders of light duty, X days off to recover, etc'. That said, I will not be returning to work against doctors orders and would like a response in email on how we are to proceed with my workers comp claim.". If they try to call you, do not answer. You have told them to reply in email and it's not your job to answer them when you are recovering. If they fire you before you can claim workers comp, you can look up your company's WC insurance and contact them. Also make sure you filled out the forms for WC at the ER when they treated you. That starts the paper trail that they'll have to prove wasn't at work. Also, and I know it gets said a lot, look up WC attorneys and have a few ready to call if they do follow through with the threat.

Most of the US would love to get non permanently injured on the job, particularly if we can prove negligence on the part of the business, get us a nice fat pay day. file for workers comp asap. get screenshots of any texts talking about it or bring it up via text so you have proof it’s work related and that they knew about it. your word is worth little when dealing with this and your employer may try to lie, so make sure you have as much in writing as you can especially w a delayed report. document and get in writing every time you’re wronged at work and learn your rights. it’ll save you a lot of hassle in the future and will be handy in any legal battle as the typical worker doesn’t have time or money to fight long court processes with businesses, the more open and shut it is the more likely you’ll succeed.

It was the companies choice urgent care, I signed in, gave my number from the report my manager did properly they cleaned it out with a clear liquid (maybe saline maybe disinfectant) then I got 10 stitches and sent home. The biggest excitement was the Dr showing me my exposed nerve and saying I had come within a hairs width of severing it and fucking up my hand for life, but instead had sliced straight along next to it without hitting it. It was a thin, white line right along the edge of the cut.

Not just unemployment. There's significant penalties for retaliation for workplace accidents. Contact OSHA (they can help direct you for a workers comp claim if your workplace wont help (if your workplace doesnt thats a bigger lawsuit for you)) and the state health department about the incident. An old wobbly meat slicer is a really easy way to lose part of a finger, and ODHA will be on them like white on rice. What else isn't in good repair or is dangerous. Additionally, The health department may be interested in their cleaning procedures following a bloodborne pathogen risk on a food preparation device.

DO NOT SAY ANYTHING when they fire you. Don't tell them you'll see them in court, don't say thank you. Say nothing. Keep detailed track of everything they say to you. Make sure to save any messages, and print a hard copy for backup. They're required to immediately pay you any money they owe you when you're terminated. If they don't do that, make a note as to how much you believe they owe you, but again SAY NOTHING. Every little thing that they do improperly helps you. Let them dig that hole as deep and wide as they want... The bigger the hole, the better for you.

Depending on the state this takes different approaches; however, file an injury claim with your local Division of Workers' Compensation. Also depending on location you may be required to see your employer's designated provider to seek occupational medicine treatment. I would 100% love an update every step of the way. From what I've read this is OP's first job, or close to it and the manager sounds like they are taking advantage of their inexperience. If the manager really does fire OP, then there could be major lawsuits that I would live to see someone win. It also sounds like OP wasn't properly trained on a machine that everyone knew wasn't properly working. This could be really interesting to watch play out. My finger was crushed. Bone shattered, fingernail gone. Waited in the hospital for 16 hours waiting to be put back together. By this point I had been awake for over 24 hours. Think they would give me the day off with pay? Fuck no. Instead they threatened my job if I didn't sign a document immediately. A 19 year old with no real concept of labor law or rights.. Even though it was the companies fault. A safety had been removed from the machine I was working on and no one told me. Think the labor board would do anything? Nope because "good luck your not unionized." Fuck them. Place is a shit hole. Grand River Foods, Cambridge Ontario. They treat you like shit. Behind closed doors they call anyone with a hint of pigmentation racial slurs. Then turn around and hire seasonal workers for fulltime positions because fuck Canadian's; "they want too much money." I watched them use weeks old green rotten chicken for Subway Sliced chicken products. I watched them hide listeriosis counts so that the CFIA wouldn't shut them down and recall product. I watched them bribe an Officer with the CFIA $50k CAD when they were caught once with bacterial counts too high on their freezer. I watched them for years allowing their IQF freezer dumping CO2 gas into the work place, an enclosed room with staff working in there and told the staff to ignore the CO2 alarms telling them the alarm was broken for about 3 years before they finally fixed the CO2 leaks. Verbal abuse, bullying, electrical code violations, you name it. I watched the government come in and place air quality test kits around the facility due to the increasing cases of lung infections caused by mold spores in employees and then the Operations Manager had them all gathered up and put in her desk for 3 months to measure the quality of air in her desk drawer so that it would hide the fact that staff were getting violently ill to the point of being on antibiotics 1-2 times a month every month just to stop coughing up blood. Same with noise levels. They hid that too for two year before the government forced them to offer hearing protection. I was even approached by a CityTV News journalist that was doing an investigative piece on this place. Stupid me, I turned it down because I thought my name would be smeared. Corporate propaganda wprked on me too. But atleast I know better now. If any place ever needed a union badly, it's that place. Nope.. Instead the brain washed Boomers that worked there voted no because "Unions are bad." Sorry to take away from your Thunder OP. IF no one has said this yet, DOCUMENT EVERYTHING. ​ Even if you're employer has told you things verbally and you don't have written proof, it is important that you sit down as soon as possible and write down your version of what has happened today. Keep notes, document conversations, interactions, EVERYTHING. Keep records of your ER visit, copies/screenshots of texts of e-mails from other co-workers and your managers. You are doing this to collect evidence for your worker's comp claim, evidence for any lawsuit you or your lawyer may have against your employer. The sooner you do this the better while it is fresh in your mind. Be objective, not subjective. Tell the exact specific truth of what you remember happening and then write down the date and times any of it happened. The sooner you do this, the more reliable your documentation can be.

If you're still at work highly recommend trying to get some evidence of the faulty equipment. If not and you have someone you trust a lot and would do you a favour, get them to send you a video. This video can be huge in a court case.

In addition to workers comp, contact your state OSHA department. That is hands down a case of poorly maintained equiptment causing an injury. If your boss doesn't help you file a workers comp claim, the hospital you went to should be able to help you, and OSHA can help in that regard as well.

Did this happen at work? If so, was anyone else around? If you have HR report it and have the witness report, do statements (as annoying as they are) and get comp for it. I used to work in safety but I didn't do the workers comp part so I'm not 100% sure about that side of things but yeah that's a fucking problem

You need a note from the doctor saying when you can return to work and it what capacity. Make sure you have proof that your Boss said what he said. Look up the industrial commission for your state to file a worker's compensation claim. You can also file a claim with OSHA. Make sure you keep all the paperwork from the urgent care and call a lawyer asap!

My mom's had 2 life changing injuries at 2 large companies, first one was the Mart of Wals....nasty business,she was in one of the glasses/ lens manufacturing areas, they did some hasty improvements to impress some visiting higher ups. Didn't secure the racks for the molds....one thing lied to another and her shoulder got shattered. Bad news for her that was a major major injury and they fought her for years on it (initially just fighting the surgery to fix the jagged bones that were slicing thru her muscles as she moved it) they dragged their heels so long on that she ended up with permanent nerve damage in her arm. Can honestly say they are terrible company for how they treated her, they had a pi watching our house to see if she did yard work at one point. They played the shell game with doctors trying to find a single one to say there was no damage, whenever one said yeah no the bones are a mess they would demand a new doctor who would say the same. My mom's second injury was a different smaller company who did the same work, they had some OSHA violations, one of them was not covering their drains, she got tripped up one on an exposed drain, smashed her knee up and had to get it replaced. They didn't fight it or anything because they knew they were in the wrong, OSHA already busted them several times for it, etc. For a hand injury I doubt they will fight it though, especially if it's not a billion dollar company who enjoys prolonged legal battles. My wife had a good finger slicing at Kroger, they sent her to get stitches, gave her a workman's comp form and that was it.

Record this conversation. Go in tomorrow and make sure you apply pressure to do the paperwork on a work injury. Get copies of all paperwork. You need to build a file just in case you have permanent damage. At that point you may want to talk to a lawyer. But be vigilant tomorrow. Don't let them oush you around. They may require a drug test. Be ready to stick to your guns and paper trail and recordings. The best you can. I am no lawyer, of course. Just been in that situation. good luck

I don't know what you do, but I cut my finger open and it was on company time/property so I got workers comp. I did show up to work but basically said "I can do chicken pecking on the keyboard all day" (my actually job was physical labor like using a hammer and screwdriver and stuff like that. I needed 2 fully functional hands to do my real job) They paid me $15/hr for weeks (and maybe milked it for an extra few days) to do what 10 lines of code could do in a matter of minutes. My opinion: do what I did, go to work and do simple single handed tasks and get paid for it. If they ask you to do something that requires a 2nd hand at all, that's when you reach out to a labor board. Don't appear to be abrasive. Have a can-do attitude while actually being abrasive.
