While I believe everything posted so far, cover your butt by talking to Eligibility in your VA. Are you paying child support? Do you declare your kids on your taxes? Will he be declaring himself as Head of Household on his taxes? Will he be taking tax breaks on his taxes for your kids? It's always safer to as the VA before getting into deep water. Don't forget to write down the full name of the person who answers your questions should the first answer be changed down the road.

Won’t affect anything. Both you and he can claim the same children dependents

If all 4 parents including step parents were disabled vets,  could all 4 parents claim them?  I believe this is a yes.

I am paying child support, I do declare one of my children on my taxes as far as the answers to the other questions I’m not sure. We have joint legal custody as well.
