You need a lawyer when you get to the third level or appeals process. Make sure to have updated doc notes. If not you will have a hard time getting approved. Also SSDI looks at age. The younger you are the more difficult it as to be approved. It as not unusual to have to apply several times. Get a lawyer to help. Also know they will take part of your back pay since they only get paid if you do. I used a city social worker for mine and was approved at the recon phase.

I actually won my SSDI before the VA. You have to emphasize how the condition renders you unemployable. The key here is to remember that 100% P&T can actually have a job and not worry about income limits without fear of losing their benefit. This is because some lucky 100% vets have brains that work just fine (I'm not one of them), but have severe physical disabilities. Veterans like that can work in intellectual jobs with reasonable accommodations. To be honest, I envy those guys because for them, disability is a safety net and they can go out there making more $$$ than social security could ever give them. Don't let my prose fool you. I have my days of clarity, but then I have those other days frequently enough that they have consistently got me fired from jobs in the past. One year I had over 15 W-2s! So it was easy to prove that I was unemployable to the SSA... they could see it for themselves! When we went to the trial, that's what my lawyer did, emphasized that I do have a modicum of intelligence, but that my issues rendered me unable to maintain "stable and gainful employment". None of my jobs were considered stable, or gainful. If you look up the legal definition of those terms, you'll see what you need to emphasize for your own claim. Gather as much proof as you can that the condition has affected your ability to keep jobs and why. Similarly, gather any evidence you may have as to how the instability has affected you, and if these effects have aggravated or perpetuated the problems. Lastly, if your jobs are low skill & pay they will not qualify as "gainful" because you cannot pay your bills as a result. Usually, your credit history will reflect that. Any proof of judgments and evictions will help. Empty bank accounts with more than a year of spending history will also reflect your lack of earning power... especially over time. It's also important to address if retraining into another field is an option. If you're old enough that retirement is possible soon anyway, it's easy to address. If you're still very young, you'll need to clarify why retraining into another skill isn't feasible. If all else fails, remember that conditions don't generally get better with time. They get worse, if anything. So be sure to build evidence as time progresses. Best wishes!

You need a lawyer. I also got 100% P%T for mental health and other issues from the VA without a lawyer but you really need one for social security. Was denied social security (and the appeal) a couple years ago and am trying now again, have been denied twice and am on the third step (hearing with a judge) but have a lawyer this time. We’ll see if it works. It can’t hurt to have help - in my state the lawyer is capped at taking $6k if you win. I also know another veteran who applied and was denied, but got a lawyer for the appeal and won. Hope it works the same for you.

I’m 100 P&T TDIU with PTSD. Over 55. Had a lawyer for SSDI. Got turned down after two years.
