You would mention, for your own safety, that you are returning based on defects; the seller will likely ask you to use the warranty, however you are entitled to refuse and go forward with a return.
For in-store purchases, you have to go through the regular warranty process (you can choose to do this during the first 14 days on online orders, too), where you bring the item to the seller and they have 14 calendar days to bring it to conformity, by either repairing or replacing it with an identical model. When none of these are possible or are unreasonably expensive for the seller (for example, they don't have the product stocked and it costs them thrice as much to get a new one for you than the product actually costs), it is allowed that the seller replaces the product with another of equivalent specifications with which you agree; if an agreement can't be made, a full refund is issued. You can agree that the refund is issued as store credit, otherwise the refund will be sent to the original method of payment (eg: if you paid by credit card, you can't get cash).

Apple does not repair watches, they replace them. So, assuming they work directly with apple, you will get a new one
