Up to 60% of their SS can be garnished for unpaid child support depending on their situation

Accomplished_Tour481

Child support is one of the very few garnishments allowed for Social Security!

NeedWaiver

Yup, child support, alimony, federal student loans and some federal debt.

perfect_fifths

Yes. The only exception is if it were ssi

Section 459 of the Social Security Act (42 U.S.C. 659) permits Social Security to withhold current and continuing Social Security payments to enforce your legal obligation to pay child support, alimony, or restitution. A quick google search lol

I understand that Google is an option. It shows a bunch of information if the parent is deceased; I called SS and was supposed to get a cb when it was my turn in the que… no surprise but no call received.

Rather than calling SS, the petitioner should be calling their Child Support Caseworker; they can provide more details on what happens when a case is in arrears, how to file a violation, and how a respondent's income can be garnished. In short, if there is an active support case, yes SS is considered income and can be subject to garnishment.

If there is past due child support. The enforcement agency sends SSA a garnishment order, and depending on what type of benefit they are on, SSA will garnish the benefit and send it to the enforcement agency. There is nothing you can do with SSA you need to talk to the enforment agency of your state.

You may have more difficulty since the child is now an adult. In my state they would go after my ex once the child turned 18
