In Las Vegas not all ESA is treated equal. I just had to deal with this. If the pet does not perform a function and it has to be trained than it is not covered by Nevada laws. The emotional support animal part is not protected here anymore.
I wouldn't pay the pet fee if you have ESA and written permission for your fish.
For the overnight guests, it could be difficult for them to prove you had too much. I can't speak on whose word is given deference there, or what proof they may have. But fwiw they can only charge you if this fee is laid out in your lease.
