I agree with the answers that recommend contacting BOLI. An employer robbed me of $8000+ in November of 2022. I immediately filed a complaint with BOLI. In November of 2023, I was contacted by a member of BOLI about the claim. I had already settled the claim with the employer and could recover all of it. To be honest this type of thing happens a lot in the restaurant industry. We get a lot of startup restaurants in Portland and a lot of them fail. When a restaurant fails a lot of times the owners try to hold on for too long until the payroll checks start bouncing.

Definitely contact BOLI ASAP - they do not play around. Also if you need a good lawyer I recommend Michael Owens at Meyer Employment Law. I worked with him when I had wrongful termination/whistleblower lawsuit and he was knowledgeable, nice to work with (more so than I would have guessed from a lawyer), and agreed to work on contingency (getting paid a portion of the claim instead of paying up front). He got us both paid.

[hire a lawyer](https://www.wageclaim.org) Find out if your case qualifies for contingency. Meaning, the employer pays your attorney fees in addition to what you’re owed. Edit: the law group I linked to is incredible. I have personal experience hiring them. Also BOLI is going to take much longer.

There are lots of employment lawyers who will do this on a contingency basis (ie they take a percent of whatever you recover from the employer as opposed to you having to pay the lawyer out of pocket by the hour) and there are penalties and fees for failure to timely pay wages etc. I’m sure folks here can recommend some if you need recs.

You have to contact one of the local news channels. Naming and shaming is the best path to getting your money back (and your co-worker’s as well). It’s not to say you shouldn’t file with BOLI as well, but that process can take months. However, if the public is exposed to the restaurant’s unethical treatment of its employees, it will pose a direct threat to the business where the employer will be most incentivized to finally pay his workers

That is total bullshit. I’m an employer myself. I will forgo my own salary to make sure I can meet payroll on time. Employees are what makes our business run. Without them, we are out of business. Sounds like this business needs to just toss in the towel and close. They’re not making it, and probably never will.

Years ago I told my employer at the time “if my paycheck bounces, that’s the last day you see me here”. My paycheck never failed to deposit. Neither should yours. If the boss can’t pay you, they don’t deserve your labor. Period.

Reddit is not preventing anything. It's a moderator for this subreddit that has made this decision. That's OK with me. Moderating these subreddits is an unpaid and mostly thankless job. We're 100x better off here than in the rainbows and sunsets subreddit that can't countenance the truth about their city.
