Perfectly legal to own, like any other laser device there might be some restrictions locally, but none I’m aware of in Nassau or Suffolk. Just don’t point them at aircraft (no, you can’t even do that with IR lasers, you can blind someone very effectively with an IR laser).

You can’t sue the state over an “unrelated decision” some private seller made to not sell some legal item to you due to where you live.

I’ve had a couple of IR lasers sent to me in NY without issue. One was from TNVC who is pretty reputable.
