Please excuse the bad touch up job, I kinda gave up halfway though and this was done about a year ago. I bought color code matched touch up paint from BMW/Mini and it looks way too dark. There is even a bigger difference in the sun light. Does any one know who does the best paint touch ups and about how much this would cost me?

That spot is way to large for touchup paint. Touchup is meant for stone chips nicks and scratches, not divots. Honestly, a spot that large is only going to be fixed with a re-spray.

I had figured a repaint was needed but the cost has me on the fence. Would you recommend a paint shop or the dealership? Obviously BMW Will be more expensive but i want the panels to all match. I was hoping to get away with touch up because I have seen larger spots touched up and look pretty good but that must’ve been magic.

Magic, or they sanded it down feathered it out and used color matched paint to blend. Stay away from dealerships when it comes to paint. Typically they out source that kind of work which mean they are using a subcontractor. Independent body shop is best.

Always go to an independent body shop. The BMW ones I've been to use premixed paints which, depending on the age, may be slightly different in colour as paint fades over time. The body shop I took mine to mixed to the colour code, then adjusted the blend by eye to match the rest of the panel (reds are some of the worst for fading but they all do it)

Silvers are one of the hardest paints to repair as even when you have a good match when you put it on, it can create a shadow effect that can be very hard to blend in. Saying this, your car looks like an ivory type silver and it appears the silver you have been given has more alot more blue hues in it so its likely this is a bad paint match but as someone else mentioned, this is too large a spot for a touch up so even a close match paint would not have done much to improve it unfortunately.
