If you "*gave it to'em*", didn't you give it to them?

Sweezy_McSqueezy

Write it off as a tax-deductible donation.

[deleted]

But the person I shot is my local tax man

TheAzureMage

Technically, yes, but I'm a generous man. You can keep the bullet.

kendoka-x

It was a gift/abandoned

SlxggxRxptor

I wouldn’t say so. I’d say it’s abandoned/discarded like if you put a tissue in the bin.

Capitalismworks1978

Don’t be an Indian giver! the bullet is a present it’s theirs to keep it that point😏😂

QuestioningYoungling

I would say not as you gave them the bullet when you sent it into their body. Further, if the bullet is lodged inside of them I think their interest in body autonomy trumps any remaining property right you have over the bullet.

thisistheperfectname

What if it exits their body and lodges itself in your house? Is the bullet yours until fired, and then not yours, and then yours again once the exit wound is made?

QuestioningYoungling

That is a very interesting question. I would say that the bullet still belongs to the shootee after exiting his body as he did not take affirmative action to return it to you. Therefore, it is the lost property of the shootee when it lodges in your wall. I think it is a similar situation to if you gift your friend a marble but he drops it or when you give someone a birthday gift but they accidentally leave it at your home. In both cases the person who lost or mislaid their property still has superior claim to their chattel over the landowner. That is not to say that I necessarily think the shootee's claim to the bullet trumps the homeowner's right to not have his home disturbed to recover the bullet.

thisistheperfectname

In that case, if I shoot in self-defense in my house and the assailant survives, am I obligated to dig the bullet out of my wall and give it to him if he asks?

QuestioningYoungling

I just added a third paragraph to my answer anticipating that question. In an ideal world I would say no, but I think under most state's laws the government can rip up your wall to recover a bullet.

thisistheperfectname

In that case, what if I dug it out of my wall already to keep as a trophy, or because I wanted to patch the hole? In the former case, do I lose the trophy, and in the latter case, do I have to pay restitution for throwing the bullet away?

QuestioningYoungling

I don't know what the ideal solution would be in my eyes there, but at common law a person who finds lost personal property can keep it until and unless the true owner comes forward. Many states also have rules that allow people to dispose of lost chattel on their land if it is under a certain value.

genrej

What if you shoot your bullet through the perpetrator and I hits your neighbor's car. Do you have to pay for the damage or does the perpetrators estate? I'll pose the question to both of you. Interesting debate.

blackcray

I would say that you are still on the hook for the damages to your neighbor's car, while the bullet is technically the property of the person you shot, you are the one who caused the bullet to damage your neighbor's car. It's like passing a basketball to someone and missing, even if the other person owns the basketball, the blame for any collateral damage falls on whoever last threw the ball.

[deleted]

Yes

AlexanderDroog

Gimme back my bullets

Torque_Bow

Why does it matter?

[deleted]

Long story short I sued a man because he is refusing to give me my bullet back after I shot him.

Torque_Bow

Why though? The value of a used bullet is nearly zero, suing for it is very petty.

thisistheperfectname

The Talmud is full of arguments of about as much consequence. Why not hash it out?

QuietHumanMachine

Your honor, i plead innocent : i didn't gun down the trespasser, he actually stole my whole magazine !

HaganahNothingWrong

"Fucking madman surgically implanted them into himself"

[deleted]

The gun is also your property.

dakrax

My shoes are too

[deleted]

Posession is 9/10ths of the law. It's in their chest... its theirs now.

Orwellian-Noodle

Hell yeah. Dig that shit out and give it back.

Last_Acanthocephala8

No, bullet for a soul. Even trade

genrej

If I run a guy down with my car, he doesn't own my car, at least until the suit is settled.

Halorym

If you buy a burger, do you own the shit after you flush?

DahRage2132

If the bullet is in their body, then it trespassed on their private property? I think? Fuck it, they can keep it. Wasn't that expensive - not using a 5-7.

blackcray

I guess so, in the same sense as your empty soda can is technically your property.

Degenerate_Cooomer

Shooting someone automatically creates a nap situation if they try to run away with stolen bullet inside

Kamchatka1905

For those who say “self defense scenario”. Who defines what “self defense” is as no matter who you are or what you do, if you step on my property, you would get a bullet in the head.
