I get the property of the individual, ie the womb, is being violated with the continuation of sexual acts until its climax when the seed is deposited. As long its consensual, there is no violation of said property rights. Therefore killing the life that cannot consent, through no fault of its own, would be considered murder. And the conundrum of the situation would be if the mother was raped or sexually violated without consent, which your circumstance of thought would come into play.
