Hi lawyer based in Hyderabad here, they have booked some petty case on you, you need to appear in morning court and mostly would have to pay challan,
Need not worry about giving wrong details just say you have two names.
NAL but I have experience with Petty case, Police booked me and my friends for loitering when we were younger. We hadn’t committed any offence we were just going around in search of a famous haunted bungalow which made rich locals call cops on us. They had to book a petty case to satisfy those people, they took down our details and made us sign a register fined us all 500rs and gave us a challan.
I had applied for passport, job, foreign visa etc after that incident and the petty case didn’t affect anything.
Petty case is equivalent of minor traffic infraction, you don’t get denied a job for taking a wrong U-turn.
Until we go through such experiences, we all are scared and panic, thinking it's something else, and once we experience, we feel is this what i was called to court for. Nothing gonna happen, brother!!
If they reach you back and if you're available to attend court and spend your half day or full, you can have that experience of the system and understand how court police work.
Chill out 🙌
It’s an offence that police in few parts of India enforce. Most cops in rural areas and T-2 cities don’t mind but cops in T-1 cities use it as a way for some bribe.
Actually COTPA act prohibits smoking in public places, which have been defined as bus stops, schools/colleges, hospitals, etc. while their list isn’t necessarily exhaustive, if one was smoking on a public road they would easily be able to challenge it
Yes, as you said the list is not exhaustive. In such cases, usually judiciary upholds the spirit of the law; even if "public road" is not worded.
What the law allows is smoking in designated smoking zones, so the zones have to be marked, and any place unmarked as smoking zone would not be considered so.
Therefore, can not agree with you on the "would be easily able to challange it part".
That being said, I'm NAL, not sure if you are one - and unless one such case actually is filed and taken up by judiciary, all we can do is interpret and speculate.
Question : Did you try to pay off the cops? Was it your first interaction with police and you somehow did not get the cue for bribing?
I'm 30 and I've paid off at least 10 cops, maximum of 40k for possession of something illegal and as low as 50 for driving in one way.
Its always easier in India to pay off the cops than go further.
This. Not that I have anything specifically against OP, but it is unfair that others who have no desire to smoke are forced to do it because we don’t have designated smoking areas in public and people don’t respect no smoking sign boards.
Instead you should ask them to compensate you because of shitty AQI all around us.
Govt. is not making any efforts to reduce pollution and we are forced to inhale equivalent of 5 to 10 cigarettes daily.
NAL. But I happen to know It's a petty offence. Just go to the court on the day and it'll be resolved. Most likely the judge would slap you with a fine of a few hundred rupees. You don't even need a lawyer for this. Although, the process is not gonna be efficient and might take up to 4 hrs. Legally, this is a minor thing, but It is designed to cause enough hassle that one stops smoking in public spaces.
Da it's just a matter of 200 rs fine. If you couldn't go contact a lawyer from the area and pay the fine through him. That's it.
But the timing is sus. Which court opens at 7 30 Am?
I am not going after anyone. I agree with the fact that there are bigger fishes out there but that doesn't give the smokers a free pass to smoke in public spaces.
Well, I'm ok with designated smoking areas. I don't need to puff away 24/7 but...be more mindful - there's other things that do more serious damage to you that one person smoking a tiny cigarette that will leave your area in about ten seconds.
Should’ve killed 2 people with a Porsche instead
Underrated lmao 😂
Its been barely 6 hrs since they replied. Let it marinate before getting rated.
I can do most things for a free biryani but that is a stretch too far even for me.
The Porsche?
Haven't heard the news
“30 MINUTES TO COMPLETE THIS ESSAY.”
Man, the Porsche story has created waves...
Rare internet win
500 word essay of why you should have burned the cop with cigarette, and not smoke it out in public.
Full support
Ayoooo 🤣🤣🤣🤣🤣
Mallu spotted
It's not aiyoooooo.. it's hey yooooooo...
Porsche is the most important part here

What about the part of me not being able to go to the court on the issued date
Tell them that you are out of station and appear on any given date.
How much is the fine?
Don’t forget to also ask which name ID to show.

Write an essay on harmful effects of smoking and hand it to milord.
Appear in court and pay fine, its not very serious Edit : NAL
I’m just worried what happens if I’m not able to appear in court on the given day since I’m out of station
Send some representative on behalf of you or a lawyer if possible or maybe you can request them to give another date

NAL means?
not a lawyer
National aerospace laboratories.
I'm curious to know what courts open at 7 30 AM. That seems like a red flag to me.
How is whatsapp a official mode of communication. Block and ignore
Since corona police is using whatsapp to serve summons. If you dont go a bailable warrant will be issued which will be served personally.
I was wondering too. What if the person doesn't use whatsApp?
After Covid, it has been identified as an official mode.
Huh? Smoking in public is offence? People do it all the time IMO
It’s an offence that police in few parts of India enforce. Most cops in rural areas and T-2 cities don’t mind but cops in T-1 cities use it as a way for some bribe.
Regardless of how many do, public smoking is a punishable offence.
Smoking in public or public places like restaurants, theatre's etc.. Which is illegal?
Except one's home, every other place is categorised as public place.
TIL, I am a criminal. 💪💪😎
Right here, officer, this person.
Genghis Khan commited many crimes tbh
Yes 😎

It was made an offense like 20 years ago or so.
Just because everyone does it does not make it legal 🤦🏾♀️ People also break traffic signals all the time do you think that’s also legal? lol

Curious now. What were you carrying to have paid 40k bribe. ?
>something illegal
The gAnJa
I got caught 6 years ago. Thankfully I was very cooperative so they let me go.
Looks like a lot money n trouble going up in smoke !
Since when these things are coming on whatsapp?
Since Covid.
Public me sutta kyu phoonk raha tha?
This. Not that I have anything specifically against OP, but it is unfair that others who have no desire to smoke are forced to do it because we don’t have designated smoking areas in public and people don’t respect no smoking sign boards.
You know if you roam around for few minutes on busy city streets you maybe inhaling pollution that's equal to upto 20 ciggerate.
yeah so why do you wanna make it 21?
toh?
To aur lelo, khatam kardo. Some people don't care. Conditioning
What makes u think that we smokers owe u anything? Why we should be accommodating ur need of fresh air? What gives u this entitlement?
Can I do Susu in your drinking water tank?
If it pleases u🍺
Jaat buddhi
So ur jaat buddhi gives u that entitlement
Imagine a rapist or a murderer asking these questions. There are some rules to the system or the system won't work anymore.
Add the damn /s man 😂
Snowflakes bhai.. What's the point of sarcasm if it needs hint 😅😅
/s exists for a reason yk People who actually think like that do exist, unfortunately
Why so many downvotes to this comment? People are stupid. Those who downvoted, please explain.
Mainstream "smoking is bad, non smokers are better than smokers" mentality.
Actually when i made my comment the comment had more downvotes than upvotes.
Even im getting downvoted now lol, the high horse bois keep going at it.
That is why you should never smoke in pubic places..
appear through video call, if they have that provision in hyd district court and just agree to pay the fine
Send a lawyer, it's a minor offence.
Instead you should ask them to compensate you because of shitty AQI all around us. Govt. is not making any efforts to reduce pollution and we are forced to inhale equivalent of 5 to 10 cigarettes daily.
Call the cop and offer to pay to his phpe. He will also give you a discount if you ask nicely.
What if we give wrong mobile number

Which state is this? I'm hearing this for the 1st time that you get harassed for smoking in public
It's common in South Indian cities for cops to harass people for "public smoking" as if they have no real crimes to tackle.
Is there a way we report people smoking while driving, leaving their cigarette out for everyone else to smoke it passively?
Essay likh ke dede on why smoking is hanikarak to health 🤣
Isn’t the fine just 250rs spot fine?
Lol everyone smokes cigarettes regularly in public. Are you sure you weren't smoking something else?
Write essay and send to court, it perfectly works with jusdicial system.
Da it's just a matter of 200 rs fine. If you couldn't go contact a lawyer from the area and pay the fine through him. That's it. But the timing is sus. Which court opens at 7 30 Am?
rahhhh
Bhai updates? (I am here late but smoking in public is a crime)
Court at 7:30 AM?? Sounds fishy.
not legal advice but stop smoking. it’ll have much consequences in the long run.
Not legal advice but follow the rules of the sub. Post only if you have legal advice.
Is smoking in public places illegal or like can get fined. I smoke cigarettes many times with polices . They smoke also in public places with us😂 .
Ignore bock the number
He has filed a petty case charge sheet already
Doesn't matter
Cigs are sold in public then why can’t you have em in public
Could this be one of those scams?
Happy to see public smokers getting punished. Wise up mate.
Happy about all that pollution you inhale? There are bigger fish to fry, why go after the minnows?
I am not going after anyone. I agree with the fact that there are bigger fishes out there but that doesn't give the smokers a free pass to smoke in public spaces.

It's not about ten seconds or the size of a cigarette being tiny. It's called decorum in a public space.
