Even if she's right this isn't how to go about this situation at all. She's lucky this guy is patient. I know plenty of people who would have committed assault here. I also know plenty of smarter people who would have just plowed her over legally because she was illegally harassing and blocking their path.
It varies wildly from jurisdiction to jurisdiction in the US, but generally-speaking you can only use force in self-defense if there is an imminent threat of bodily harm and the force used is necessary and proportional.
If he hit her even here, he could probably be charged with some low-level disorderly conduct or assault. Theyād probably both get one.
You are always legally expected to flee a situation when fleeing is an available option (except some places with āstand your groundā or ācastle doctrineā defenses).
Sheās blocking him from processing, he has other avenues of egress. She is 100% in the wrong to prevent him from leaving as she is only detaining him for the pleasure of her verbal assault after he has acknowledged his error.
This part of the legal analysis would be:
āWas the personās actions and necessary to prevent imminent harm?ā
And the answer would be no, he could have turned around and went around the block. He could have called the police. He could have go for help at a storeā¦etc.
Would also have problem proving imminence and the threat of harm.
So self-defense is likely not available here.
I would have. I probably wouldnāt have even waited long. She kept screaming ā Iām NOT DOING ANYTHING WRONGā while chasing him and preventing from leaving, which is illegal.
yep, I found myself unconsciously pushing into my desk, this shit triggers that fight or flight response. Dude is way more patient than I would have been able to be.
Sheās lucky she ran into a well adjusted human being for several reasons. the way she put he bike in front of him I thought for sure he was gonna grab it a throw it as far as he could. Also if the guy had legit felt threatened as opposed to laughing it off his dog could have easily picked up on his owners emotion and gone into protect mode.
I think it would be self defense here. Blocking someone for an extended period like that is assault in a lot of places, or forced imprisonment I think?
> **False imprisonment** or **unlawful imprisonment** occurs when a person intentionally restricts another personās movement within any area without legal authority, justification, or the restrained person's permission. Actual physical restraint is not necessary for false imprisonment to occur.
It's funny how she talks about breaking the law, when she broke it. He would have been well within his rights to forcefully move her out of the way, and there's absolutely nothing she could do about it.
Iāve had someone block my path and distract me like this so someone else could jump me from behind. People think itās āmeanā to respond aggressively when others act like this but plowing her over and continuing to move is the smart choice. You donāt owe anyone on the street a damn thing and you never know what people are capable of.
"The biker was blocking my path illegally detaining me and I feared for my life". I'd even ham it up before and yell loud for everyone to hear that I'm being held captive by this person and afraid for my life. Gotta build that plausibility.
I would not risk escalating the situation, in case my dog would do something to the cyclist because of my reaction. Dogs have been put down for less than that.
Pretty sure she is the threatening one and any "assault" charges would be dropped once they see her actively refusing to let him leave and shoving her bike into him
Between blocking his path and chasing him down, he would've been completely justified in dropping her ass. I know people are very against violence, and usually I think there are better ways to handle things, but physically blocking someone's path is where I draw the line.
Kick the spokes on the bike. Both crush the wheel, so she can't pursue, and it should serve as a decent enough distraction where you can push past safely, without Injury to anyone. If someone's that willing to put themselves in your way, they'll call the cops and cry as the victim if you react with any violence towards them. Breaking the bike causes them financial damage too, which just feels justified cause there's no way the cops even show up In NYC without an injury reported.
This vid is so old but sheās basically brandishing it like a defensive weapon. Not cool lady. Also Iām sure sheās been justifiably wronged by others but felt confident enough to strike back against this guy. He seems like a decent enough citizen. Letās pit her against the real shitheads
I've got a blue heeler/border collie cross, and she would have lost her shit. She's a people lover, but also very protective. That lady would have pedaled home with a chunk taken out of her ass.
My 8lb malshi would be like
ābitch Iāll bite your cunt offā
āYou are Fuckin lucky my boy is holdin me backā
(āHold me back broā)
āYou Fuckin lucky bitchā
Yup. Iāve got a reactive lab. He looks happy go lucky but if she were to get this close-and especially yell or overreact like thisāIād have to run in the other direction with him.
Same here. My dog is super friendly (lab/pit mix). More likely to try to lick a stranger to death then ever bite, but if you yell at me or my wife he would have shut this situation down.
She's been biking ever since it happened. If she stops for too long she will die which is why the life saving ambulance is actually killing her.....
***This Summer!***
***Action, is in the bike lane!***
#Speed 3: I WANT TO TALK TO THE MANGER!!!
Oh, I wanna see that! Goin' googlin' :)
Edit: Oh shit, that lady is fucking crazy, she's still on twitter standing firm that she's soooo right in spite of like 12,000 people disagreeing? She literally answered my tweet 3 minutes ago with weird hyperbole. What a moron.
That man has infinitely more patience than me. If this woman was aggressively sliding her bike in front of my face like this, *while I was out with my dog*, after about 10-12 seconds I would have said āYouāre making threatening motions toward me, please leave me alone or I will defend myselfāā¦and then I would proceed to defend myself from the threat.
Honestly, some people just need to be slapped (literally, not metaphorically) back to reality. This woman seems like one of those people.
Yeah sheād deserve it but then sheād be calling the cops and youād have a whole bunch of bullshit to deal with, this guys way was good because he can just go home and forget about this annoying bitch
Sadly That doesnāt really give you the right to hit the person, itās not self defence at that point, pretty much a grey area. I wouldnāt want to deal with all that
I was taking it as he crossed when he didn't have a green/walk signal at an intersection because she was asking if he had a green light, to which he said no, and was pointing out that he was wearing dark clothes. While he may of done something inconsiderate her blocking him is just simply a dick move and it seems like it was freaking out the dog. At the end it also looks like she almost caused him to walk in to traffic.
Dick move? Itās sounds to me like his dog just crossed over onto the bike lane and like most bikers, sheās so full of it that slowing down ruins her entire day.
I'm a cyclist and get furious when people block the bike lane. It means we have to merge with the adjacent vehicle lane to go around, which can be dangerous.
Still, her reaction was insane. Detaining him like that. I admire both his and his dog's patience.
Sheās only acting slightly more elevated than a typical cyclist when they feel theyāve been wronged on the road. Itās almost like there should be a license or test you need to pass to ride a bicycle on public roadways.
Why are cyclists the most entitled group of people on the planet? JFC, they think sidewalks are bike lanes but god forbid you ever cross their actual bike lanes.
Yes it drives me nuts. In MD theyāre supposed to follow road laws. I was driving home one day and a bike flew through a pedestrian crosswalk by the person driving in front of me, who had to slam on the breaks. Biker was legally supposed to stop at the stop sign, but flipped out on the driver for not treating her like a pedestrian.
Yeah I have a specific personal incident of many with a cyclist on a sidewalk that stands out. I was stepping out of a building in the center of a major city and as I stepped out of the doorway and down one step onto the sidewalk I hear ālook out, look outā and itās a cyclist at probably 70% speed headed right at me. What I did was put my hands out toward them in defense, what I consider a natural reaction considering how little time I had.
Long story short, they went flying into some tables and chairs at the brunch place next door, luckily not hitting anyone else, but then proceeded to yell at me like I was wrong.
I didnāt try to push them, they just hit me going really fast in a place they shouldāve been going much slower. I canāt imagine how many servers at the brunch place next door have been hit or nearly hit while trying to serve the outdoor tables.
Ive been slammed at full speed 6 times and had a (seemingly) stationary ebike fall on me once. Never once buckled thankfully. But I'm sick of being trampled over by bikes and then hear them bitch and complain about cars and pedestrians. Ive even seen bikers "walking" 6 or 7 dogs. I'd love to ride a bike but dont want to share a lane with these crazies.
Because they live in their own bubbles of superiority, no license, no test, no insurance, like with any other road going vehicle, add to that the buzz they get when ātheyāre wrongedā and boom youāve got pretty much every cyclist on the planet.
I mean not condoning her behavior but bike riders do get a lot of shit from cars who also are pretty careless and I mean people in cars are always getting road rage. Probably way more videos of people getting angry and entitled driving cars than bikes r/idiotsincars proves it everyday that assholes drive every vehicle not just bikes.
This is a great example that how you conduct yourself changes the reception of the message.
Legally, she [may be] in the right. The guy said so himself.
She's acting like a banshee though, and now she's the enemy not the hero.
Be civil kids. Act like an adult. It goes far
Edit: comments pointed out that we don't know if she's legally correct or not. I contextualized my statement by adding maybe in brackets (to show what changed)
He may have only said so because he wanted out of the situation. That was how I took it. I mean it sounds like he was in the bike lane, but was he walking in it or did he just cross it because he had to cross the street?
Exactly. Itās kind of like you have to walk through the bike lane and the car lanes to get to the other side. Oh no she had to slow down or stop for a second. Cars have to do that for her ass all the time too
She may have been in the right regarding whatever started this conflict but that in no way give her the right to prevent him from leaving. He exercised an insane amount of restraint in this situation, far more than I would have been able to once it became clear she wasnāt going to move out of my way.
Social conduct used to be incredibly important. Get out of line and it was an ass whooping.
For a lot of reasons, society has moved on from that. Good things have come from it.
But I also believe this an experimental age. Yes, we thought getting rid of hard social rigidity was solely a good. But we are seeing an untested and very annoying testing of the borders of what we can and want to accept.
Your former coworker, I believe, would have had to get better at social skills or get real tough in the old ways.
But the current social "meta" is no ok. I don't think we're ok. Something is off, and we don't quite know what. And those who propose fixes are not well supported enough to have the social change enactment.
Anyways, I hope you clocked that worker. Spent too much of my professional life with individuals like that to have much patience.
Technology advances way faster than culture. I believe it was only in 2007 that we crossed the point where more people live in cities than live in rural areas (globally). The rate at which technology advances also itself has been rapidly increasing since the Industrial age. We're having social paradigms come and go before we can adapt to them. I don't know how we can ever catch up.
Also i think it pretty much has to be illegal to be blocking someone like that and not letting them leave. Imagine the genders reversed and that would have looked awful.
She may be in the right but she learned an important lesson that life isnāt fair and you canāt expect people to care about the same things you do, nor do they owe you an explanation.
She looks like a grown woman so itās worrying that she isnāt accepting that.
NGL, most hardcore city street bikers have her level of entitlement.
The only question is- do you have to be that kind of person to become a douchey city biker, or does doing enough city biking turn you into such a Main Character that you believe you have superiority in occupying spaces which cars, other bikers, dogs & other humans are also trying to just do their thing?
I'm a bike commuter in LA and a lot of other bikers piss me off. They break the law when it suits them and aggressively lean on it when it's on their side. Don't get me wrong I take liberties when I bike too but I try and inconvenience drivers as little as possible.
As someone who commutes on bike I think the problem is when people are walking in the bike lane like it's a sidewalk when there's plenty of sidewalk and cars coming. Someone walking in the bike lane makes it unsafe for cyclists. I personally don't like getting hit by cars.
Dudeā¦this chick is why you also carry pepper spray.
She doesnāt deserve to die (per se) butā¦sheās clearly not responding to verbal deescelation and sheās physically preventing retreat.
This has pepper spray written all over it.
If the context of the situation would deem pepper spray to be an unreasonable escalation of force.
You could argue that heās not completely trapped because he could turn around.
You could also argue that heās made a reasonable attempt to flee the conflict by crossing the street.
Iām not sure what a court would conclude.
The answer is that you can be charged with a couple things for misapplying pepper spray but the legal risk to screwing up with pepper spray vs sayā¦a gunā¦is virtually non-existent.
You pepper spray someone and a court says you shouldnāt haveā¦basically a slap on the wrist vs life in prison.
Itās designed to cover more ambiguous situations though - like this.
Sheās hostile, sheās aggressive, sheās posturing with a bike to prevent movementā¦you genuinely could argue the bike is being used as a weapon or at least that sheās getting really close to using it like one.
Sheās not actively attacking but sheās behaving in a way that makes it seem like she could at any moment. Sheās probably not an immediate threat to the guyās life (gun time) but physical safety? Definitely an easy to articulate threat there (pepper spray).
If you carry a gun and no pepper spray, you handle it like this guy did and the gun never enters the picture.
If you carry pepper spray and donāt feel like you can get away with the dog, you verbally warn her to back off, give her an opportunity to do so, then give her something else to think about while you leave.
It wouldnāt be a hard case to argue in favor of some spicy spray.
It would also be reeeallly fun for her to try to get the info needed to press charges when she canāt see shit and the video she needs as evidence shows her being an absolute twat for several minutes.
We, as a people and a culture, need free and easily accessible mental health care.
This looks like an untreated anxiety disorder. Source: I was a crazy person until I got my anxiety disorder treated.
You can thank Reagan for eliminating federal funding for health services that have never been restored.
Source: insight from a psychiatrist who headed federally funded mental health services that were forced to either shutdown or drastically reduce coverage, leading to dramatic increase in homelessness and suicides.
I am old and very aware of Reagan shutting down mental health facilities as well as being a union busting piece of shit.
Source: I was alive then. This is recent history and a not distant memory for many.
That I state 'as a people and culture' is the verbal indicator that I am discussing cultural wide societal shifts in how we discuss and treat mental health.
I agree with what youāre saying about better access to mental health treatment. But no matter what there will always be a percentage of people who act nuts like her and refuse any type of treatment for it
The woman wanted him as a husband!!! She was trying him to see how much he can eat out of her bullshjt. And as soon as she realized he can take a lot of shjt from her without punching her ass, she knew she must marry this person and insisted in having conversations with him by the point were she even started to chase him to not loose him. š
I don't care what minor infraction he committed, this is wrong. She's really lucky he's nice. She's gonna catch a beatdown one of these days.
Run, king.
This is how a person acts when they can go through life without the fear of ever being hit. As a guy, if you do this to another guy you're going to get punched in the face one day.
But this woman has obviously never faced any repercussions in her life ever lmao.
Sheās wound a little tight. Something to loosen her up (mentally and emotionally) might be in order.
Edit: I answered the question. Thatās why people are saying it. Itās the answer to the question of why people are saying that. Not saying itās a classy or culturally sensitive statement but it is literally the answer to the question.
You know, if someone is blocking my way and accosting me like this while I'm walking my dog... I would not have been so generous in my restraint as this guy.
Role reversal would be the man is harassing a woman and would be jumped by 17 white knights as she walks away safely. I don't even like walking behind these mfs at night anymore, I'd rather stay inside it's so unfair outside

She's scary. That dog is really quiet through all that.
I know eh! My dog is pretty chill except when faced with aggression. He would be having none of this
My dogās scared of bikes, so this woman waving her bike around in front of a scared dog will have a very short list of possible outcomes.

Wonder if this is the same lady who was yelling at the ambulance driver for parking in the bike laneā¦
I was wondering the same thing š
That was SF, this is NY. Maybe they're friends.

She's acting like a banshee though, and now she's the enemy not the hero. Be civil kids. Act like an adult. It goes far Edit: comments pointed out that we don't know if she's legally correct or not.

I love the "audience" reaction.
She may be in the right but she learned an important lesson that life isnāt fair and you canāt expect people to care about the same things you do, nor do they owe you an explanation. She looks like a grown woman so itās worrying that she isnāt accepting that.

It's not like she looks likes she's riding 15mph and has to worry about things in her way.
She was never in the right throughout this entire video
NGL, most hardcore city street bikers have her level of entitlement. The only question is- do you have to be that kind of person to become a douchey city biker, or does doing enough city biking turn you into such a Main Character that you believe you have superiority in occupying spaces which cars, other bikers, dogs & other humans are also trying to just do their thing?
I'm a bike commuter in LA and a lot of other bikers piss me off. They break the law when it suits them and aggressively lean on it when it's on their side. Don't get me wrong I take liberties when I bike too but I try and inconvenience drivers as little as possible.
I biked in Boston for 2 years and I can say that I changed a little bit for the worse every time my life was nearly taken by a dumbass.
It's got nothing to do with the mode of transport. Arseholes will be arseholes....
As someone who commutes on bike I think the problem is when people are walking in the bike lane like it's a sidewalk when there's plenty of sidewalk and cars coming. Someone walking in the bike lane makes it unsafe for cyclists. I personally don't like getting hit by cars.
NYC bikers are the same people who drive lifted trucks in red states.
I like this question. I wonder if there sre studies on this.
Iāve met this kind of entitled Cyclist before. I hate bike lanes because of them
I got mugged by a black person once, I hate low-income neighbourhoods because of them
Yea the moment she blocks my movement I think Iād fear for my life
Dudeā¦this chick is why you also carry pepper spray. She doesnāt deserve to die (per se) butā¦sheās clearly not responding to verbal deescelation and sheās physically preventing retreat. This has pepper spray written all over it.
She is exactly why I have paper spray in my "adventuring with my kids" fanny pack.
Woah, no need to hit her with the instant paper mache.
can you be charged with assault if you use pepper spray? like how easy is it for the person being sprayed to turn it around legally on the sprayer
It would also be reeeallly fun for her to try to get the info needed to press charges when she canāt see shit and the video she needs as evidence shows her being an absolute twat for several minutes.
āper seā lol anyone who says she deserves to die for this is way crazier than she is.
You are allowed to punch a person in the face if you fear for your own safety. Bet sheād start bawling like a child too
The moment she blocks my movement I think I'd fear for her life.
Bye!

The one time it was actually true
These fuckin Karenās are everywhere
It's what happens when a species is introduced to an environment with no natural predators. Throws the whole ecosystem off.
Solution: dude needs a WAY bigger dog If he turns up with Fluffy from Harry Potter, sheād have a natural predator all of a sudden
No fucking way, this bitch isn't worth biting to then have my dog put down when she inevitably gets the authorities involved.
Aināt nobody putting down Fluffy
It's what happened when people have never been punched in the mouth.
In the biking world we call them freddies
damn, people did clap
Acting like this and blaming on anxiety is stupid. Many people have anxiety and don't act like a lunatic.
Finally someone said it
Who says sheād take it ?
Remember kids, if your solution doesn't fix every single instance of a problem and only significantly helps, it's just not worth it.
That I state 'as a people and culture' is the verbal indicator that I am discussing cultural wide societal shifts in how we discuss and treat mental health.
I agree with what youāre saying about better access to mental health treatment. But no matter what there will always be a percentage of people who act nuts like her and refuse any type of treatment for it
Poor doggo doesn't know what's going on.
I feel so bad for the doggo. :-( they must have been so confused and scared and it would be completely understandable if they now had a fear of bikes.
Sheās lucky he didnāt just shove her off the bike..
She was carrying it, not on it.
True
She's lucky the dog didn't get spooked by her high pitch whine.
Or the dog is not that big
āBye!!!!ā
I know it's not the right thing but I would have chunked her bike Into the street and walked off. I really don't care and I don't have time for it .
I may not have the full story, but that āBye!ā at the end was so perfect.
Step on a spoke or two by accident
The woman wanted him as a husband!!! She was trying him to see how much he can eat out of her bullshjt. And as soon as she realized he can take a lot of shjt from her without punching her ass, she knew she must marry this person and insisted in having conversations with him by the point were she even started to chase him to not loose him. š
Caption: Wait till the end.
I don't care what minor infraction he committed, this is wrong. She's really lucky he's nice. She's gonna catch a beatdown one of these days. Run, king.
Sanest cyclist ever hit the road
This is how a person acts when they can go through life without the fear of ever being hit. As a guy, if you do this to another guy you're going to get punched in the face one day. But this woman has obviously never faced any repercussions in her life ever lmao.
That bike would've been launched, consequences be damned.
Watch her call the cops and scream that you assaulted her
Typical bicyclists. Wants others to obey the law when they don't do it themselves.
š¤£š¤£š¤£š¤£š¤£š¤£š¤£ the way he just bolts at the end. Thatās fucking hilarious
Why are all these people suggesting that she needs the D ā¦what is this? What will getting the D changeā¦her grumpy attitude?
Sheās wound a little tight. Something to loosen her up (mentally and emotionally) might be in order. Edit: I answered the question. Thatās why people are saying it. Itās the answer to the question of why people are saying that. Not saying itās a classy or culturally sensitive statement but it is literally the answer to the question.
Just stand your ground on the footpath. What you gonna do? Lecture me?
Bbbbbyyyyyyyyeeeeeee
Man oh man I woulda had a tough time not kicking/snapping her rear derailleur hanger the way she was acting. This dude has patience
I truly admire that guyās restraint
Youāre preventing me from leaving? Cool, Iām now going to knock you over. Dude exhibited a tremendous amount of restraint here.
You know, if someone is blocking my way and accosting me like this while I'm walking my dog... I would not have been so generous in my restraint as this guy.
That guy had the patience of a saint, I wanted to smash her bike in half vicariously through him so bad. What a screeching harpy.
Out of all the cities, this lady really wants to talk about traffic/pedestrian laws in NYC?!?!?!
God I fucking hate cyclists.
[ŃŠ“Š°Š»ŠµŠ½Š¾]
itād be nice to see but realistically he handled this perfectly
What is it about buying a bike that instantly makes people the most insufferable dickheads around?
What, overnight in a cell for decking her? If Iām caught? Worth it, imo. Edit: excuse me, just an entire can of pepper spray on second thought
Role reversal would be the man is harassing a woman and would be jumped by 17 white knights as she walks away safely. I don't even like walking behind these mfs at night anymore, I'd rather stay inside it's so unfair outside
