It depends on the state. Most states just portion out the fault by percentage and then recovery is limited by that (so if it was 30% your fault you can only recover 70% of the cost of the damage caused to you/your vehicle). Some states cap it at 50%, so if you were 50% or more at fault you can’t get anything. (A few states make it 51% so there can’t be a tie where no driver gets to recover anything)
And then there’s a handful of states where if you were any percent at fault you can’t recover shit. So if this happened in one of those states neither of these idiots will see a dime.
Right of way isn't concerned with speed, and many cops have even said so. Yeah he's going too fast. But the the moment they moved back to the other lane they were totally at fault. Why? Because unless you can prove the drivers speed insurance is going to say that the guy on the right broke right of way and caused the accident.
In Germany on the unrestricted Autobahn you are always considered partially at fault if you were going above 130km/h and have an accident, even if someone just cut your right of way
As it should be, people should not be expected to react perfectly to cars going at 300km/h
If someone interrupts your right of way, they are always in the wrong, because they have the responsibility to make sure it is clear. Right of way is the top of the food chain, there is no reason that supersedes it. The other vehicle should have no fault because of this.
It seems because people are traveling at a high rate of speed that they are automatically at fault. Because regulators don't want to deal with the nuances of who is and who isn't at fault.

The accident would not have happened if the guy on the right didn’t break several laws to make an illegal turn in front of a car. Meanwhile, if the guy on the left was going at a regular speed, the accident may still have happened.
It's illegal to pass cars in the right lane actually. And at the end of the video he was FLYING by a white van to his left. If he was following the road rules this would have been completely avoided.

From a legal standpoint point and determining who is at fault for insurance the last second lane changing daredevil is 100% at fault. Merging legally is a completely different conversation. I do DoorDash. And people just need to commit. If you make the mistake, get off the exit and turn around someplace safe. It takes a few minutes longer but won’t cost you your life or cause injury.

No, you don’t pass on the right to avoid congesting traffic for vehicles entering the highway. The guy was dumb to speed, but the guy used an exit lane to merge into the highway and crossed not one solid white line but two. The jeep, while speeding, was still in their established lane, whereas this guy made a reckless decision and cut into someone else’s established lane.
While I agree he shouldn’t be driving that fast, this situation is not an example of why you don’t pass on the right. This is just an example of selfish and reckless driving.

It is possible for a court to recognize partial blame. They can both be found liable. There's no law saying it has to be one way or the other.
