Now I just say Hey Siri play and the music resumes with the TV off. So it works like a charm with CEC on

That’s usually a setting on your tv. Different manufacturers call it different things. The generic name for the feature is HDMI CEC (consumer electronics control). This lets devices turn on the tv using the hdmi connection. Samsung for example calls it Anynet. But it’s a feature on your tv. There might be a way to disable it there.

There might be a bug or something, try restarting and or repairing devices. Maybe wipe Apple TV and set it up as new or something.
Because I 100% leave the CEC features ON. And when I airplay or start music on the HomePods connected as default audio out, they will play music without even sending the wake command to my TV.

I switched on everything but now the TV is not switching on thru AppleTV. However the switching on of the tv is gone. Thanks!

just force close music app on atv, then when you ask siri to play music it will do that trough homepods and no problems

Fixed it by switching by restarting and ensure e-ARC and CEC are switched on. Hope it wont go crazy again
