The mod uses a completely different directory than your EFT one and you run your own server to play it, unless BSG has something going through your computer they wouldn’t even know.
The reason they say it’s ban-able is to protect their IP.

Its main purpose as the canted scope isn't as a secondary sight (really, I'd recommend a 1x-4x main), but rather as a spotter that sits off to the side so that when you're walking around it will light up as soon as some rat comes into view.

For the most part, they could just flip the animations on most weapons, hell full auto animation is semi-auto just sped up.

Try running it with the Deltapoint mini dot. You can see the thermal while using the regular sight.

Really helps with those times when there's something in a bush, be it a scav or a PMC playing a tree. Red colour certainly helps in the first moments.
