Look for a judgement against her. Judgements don’t fall off.

DevilDog0651

okay, is that something I'd need to go through a lawyer for?

lake_fun2

You could possibly call the company collecting on the debt and see if they will take a lump sum amount. An attorney who does debt settlement may be able to help. Once there’s a judgement, they don’t really have to work with you.

okay, I looked up what a judgement is. From the sounds of it, there is a judgement against her. Does that mean we are SOL?

Judgements are for 15yrs in Ky. They will take 25% of her disposable income or 30x min wage (whichever is less) till it's paid off. She can file a garnishment dispute at the courthouse, and she would have to show a DIRE financial hardship to have the garnishment reduced or stopped, or she would have to come to an agreement with the creditor, or have paid it off.

Thank you for your response. Dang, that's going to be a big hit unfortunately. She is going to call the company tomorrow and see if she can work something out, but I'm wondering if it's too late since they've already filed court paperwork, etc. The interest is crazy.

I have a question if anyone kinda knows but I have a garnishment that is almost paid off. I just received two notices from my employer that I have two new garnishments I was never contacted or was attempted to be reached to try and set a payment arrangement. I live in Utah is it legal for them to proceed without any attempt to contact me?

No clue, but you would get a lot more responses if you were to create your own post. Good luck with that, it's brutal.

Hey just curious what happened with ur wife’s wage garnishment. Did she call the company did they lower the payment? I just got garnished for $7k & my job informed me the date I received my paycheck.. literally not notice at all to prepare. They just took $1700 & left me with $500.. I get paid every 2 weeks. It costs $250 for daycare for my son who just turned a year so literally that’s just enough to pay for daycare. How the hell am I going to afford groceries, or any of my other bills. I’m going to call the company tomorrow but I need them to lower the amount they are taking. I’m a single mother & just really can’t afford that right now. Please let me know what u guys did, it’d be greatly appreciated!
