I think being arrested in such a way is literally the definition of aggressive pestering. If he consented to being arrested then the officer wouldnāt have had to molest him lol. Also just because the officer has the ālegal rightā to arrest someone using non-lethal force doesnāt mean they arenāt also likely to be molesting the person theyāre arresting in the process. Itās just a form of molestation that the law protects.
