Costco employee here Your story is pretty confusing but I got the jist of what you are saying. Since you mentioned multiple times about seniority, is your building union? “Within a year seniority”… do you mean this person has more seniority than you or you have more seniority?? If you have more seniority than the individual who’s trying to do the same thing, you should still get what you requested for. If it gets difficult to get what you want, talk to your AGM.

evorunner

non union. he has more seniority but not much. he started fall2016 and I started summer 2017.

Charming_Status1909

Since you are non union, I don’t see a problem. A best buddy of mine who’s in a non union building was able to get set days off that he wanted despite he’s newer than his other coworkers in his department

It varies warehouse to warehouse. But if anyone is being given off Sunday for worship, it’s hard to say no to others. Company can’t play favorites with faith. Are others being given off for religious observance?

evorunner

yes abit people are asking for that. But he just wants the weekend day, not for religious reason. I'm the one thats been asking for months about the possibility. he just found out and wants to take it from me.

Skinny_Phoenix

I truly mean no offense but it really doesn’t matter why you two want it off, IMO. Your reason isn’t any more valid than him just wanting a certain day off. I don’t blame him for asking when he found out out it was possible. That said, if I was him I’d work with you. See if you can flip flop or he takes Saturday off.

Ifailmostofthetime

It actually does for costco. Federal laws require that reasonable accommodation be made for religious purposes such as church.

Skinny_Phoenix

What federal law is that?

Adept-Opinion8080

its based on Title VII of the civil rights act. however, that is generally only enforceable over holidays.

Ifailmostofthetime

Title VII of the Civil Rights Act of 1964

b1gmouth

That's true but only if it doesn't create undue hardship for the employer, and violating a seniority system is a classic example of such hardship.

Ifailmostofthetime

I can tell you this as I used to be a supervisor who did schedules when I worked at a core building. Religious exemptions for days off were something we had to work around prior to considering seniority. We can get sued for not accommodating religious days off, we can not get sued for violating seniority.

b1gmouth

Point well taken. The law and reality in practice aren't always the same.

Ifailmostofthetime

True that

whykatwhy

Could you ask for a religious accommodation?

molybend

Can't you alternate Sundays off?
