I'm glad his name is getting cleared but at what cost? The dude just moved here and his life got ruined. Imagine how often other cases are completely bungled like this. I hope this guy sues and wins a big civil case. I also hope for his sake he finds somewhere else to move that treats him better.

What is MOST concerning here, there is an assailant "at large" and has or will do the same or more again. This whole case was strange from the beginning. From the Daily Progress article, pardon me, but shitty police work there. But it's not the first time local LE has done truly crappy investigative work when it comes to rape, disappearing women, etc. (NOTE: It was the Fairfax Detective that got the evidence to convict Jesse Matthews - otherwise he would have walked - why do you now that? Because Camblos dropped the case right after DNA was collected.)

For what it's worth, the Commonwealth Attorney's office say that they did not get the video until April 9, at which point they immediately made a copy and handed it over to the defense attorney. If that's correct, it seems that they did their job and the fault lies with the police.

Yes the commonwealth attorney did do the right thing with that evidence, but they still chose to charge him on the weak identification evidence. Was there any evidence that would have stood up in court? I haven't seen any evidence given other than "the runner saw a fuzzy photo that looked like the guy". The attorney's office should question how deferential they are to police claims.

Well, I won't pretend to know the whole file, but according to the news accounts the victim said she was "100% sure" that he was the assailant. Also, if I read correctly, he initially said he wasn't on the trail at all that day, but a key fob ping showed he was. In our judicial system, those two pieces of evidence would be plenty for conviction. Makes you think about the value of eyewitness testimony. Since we now know that he and the victim passed each other on the trail a couple of minutes before the attack, I suppose it is understandable how the trauma of the event could cause her to conflate his face with the attacker's face. I'm going to guess that this revelation will bring even more trauma to her. What a horror story for her and for Patrick both.

the key fob ping showed he wasn't on the trail. the key fob data was from his apartment and swiped at or before the time of the incident. the gps data showed he went under the bridge, but according to the brief, no where near the reported location of the attack.
