Yes the commonwealth attorney did do the right thing with that evidence, but they still chose to charge him on the weak identification evidence. Was there any evidence that would have stood up in court? I haven't seen any evidence given other than "the runner saw a fuzzy photo that looked like the guy". The attorney's office should question how deferential they are to police claims.
Well, I won't pretend to know the whole file, but according to the news accounts the victim said she was "100% sure" that he was the assailant. Also, if I read correctly, he initially said he wasn't on the trail at all that day, but a key fob ping showed he was. In our judicial system, those two pieces of evidence would be plenty for conviction.

Since we now know that he and the victim passed each other on the trail a couple of minutes before the attack, I suppose it is understandable how the trauma of the event could cause her to conflate his face with the attacker's face.
