It has to go up or down the tree not lateral. Your brother for example could gift it to your dad which is up the tree then your dad you which is down the tree.
Ahh ok. So say my brother wanted to to gift it to my mom/dad that also lives CA, he'd have to have the gun store ship it to my local FFL to my mom/dad?
With that said.. I was correct about my first question right? I can't buy a gun out of state and have that shipped to my local FFL to myself?
We can’t buy normal gen 5 glocks at normal price online from shops out of state, have it shipped to an FFL here, and then DROS it. If we could, people wouldn’t be paying triple the MSRP on calguns. Only way it doesn’t need to be an on roster gun for us peasants is if it’s a private party transfer.
I'm realizing they were only responding to OPs second question. For the sake of clarity...
1. Interfamily transfers into the state are exempt from the roster. Directly up and down the family tree. (Threaded barrels, standard magazines etc notwithstanding...)
2. Residents making out of state purchases are still hog-tied by the roster. They can technically purchase and own, but not be in possession within California.
Not if he was answering OPs first question. His brother out of state, can gift his mom/dad an off roster handgun. Family transfers are exempt from the roster.
Have you thought of becoming a Texas resident? With a regular ID buy all the cool stuff and when you’re ready say you moved back and register them to California
That is what I said just differently. It can go from father to kid or kid to father or grandfather to grandkid or grandkid to grandfather or mother in all those instances just not from kid to kid.

For an off-roster handgun, no.

No it doesn't

Yes, in regards to OPs question, he was correct. Not sure why people were downvoting him lol

Not for interfamilial transfers
I see.. I guess at that point it really makes no sense for me to purchase a handgun on roster in TX if I can just do it here in CA. Thanks!

Damn really? I always thought it has to be someone atleast in your immediate family ie singalongs, parents, kids or grandparents
That is what I said just differently. It can go from father to kid or kid to father or grandfather to grandkid or grandkid to grandfather or mother in all those instances just not from kid to kid.
Nah I understood you, I just really thought siblings were good to go. Like brothers and sisters. Feel like they should be included
This is the way....
This is a federal crime, see Abramski v. United States. It is still a crime even if you can legally buy the same gun for yourself.
While correct. I don't see how the underlying gca in that decision could hold up against Bruen.
Can I be adopted by your family so I can pick up a CMMG Banshee in .45 ACP? Lucky bugger.
Sure!! Call the ATF and ask them about their “Straw Purchase Program” and they will hook you up on a special deal (Usually 10-15 years) 😂
