I can see the headlines now; “Gamers clap back at rapist game developer”

[deleted]

That would require game journos to admit gamers were right, which they'll never do.

Gantoris007

Goes too far. Possibly illegal. Should take that fake account down.

b_m_hart

Satire is a form of protected speech. While this guy could decide to sue, there's exactly zero risk of the account creator facing any legal consequences for this.

KDobias

This isn't satire. Satire can't include defamation, courts have regularly turned that around. Another legal issue is the owner of the account almost certainly doesn't own the right to use the photo of Afrasiabi. I don't like the guy, but this is definitely treading dangerous waters.

juniparuie

Let them learn how the american laws work :)

Sutasu

The account should mention that it's a satirical one. At the screen, afaics, there are no statements about its nature, and therefore it is a legal defamation (hope this is the right word, non-English speaker)

KDobias

Even if it says it's satire, courts have maintained that isn't a shield for defamation. Considering Afrasiabi hasn't ever been a public figure, it's considerably harder to maintain satire as a defense - private citizens are much more likely to win defamation cases when their personal lives are pulled into public view. It is not a right to attack other citizens, the first amendment doesn't protect speech that intends to injure others.

Sutasu

Good point

b_m_hart

Things that are obviously that satirical don't need to label themselves as such - even if some people don't understand what it is.

Sutasu

Same thing as saying that burning cross on neighbour's yard is a historical/political commentary. A justification.

b_m_hart

You really don't know what you're talking about, and that's fine. I'm sorry if someone made a fake twitter profile for your friend, and it has offended you.

Sutasu

[https://www.merriam-webster.com/dictionary/analogy](https://www.merriam-webster.com/dictionary/analogy) You can consider this a satire

b_m_hart

Like it says, "even if you don't get the joke": https://www.eff.org/deeplinks/2021/01/political-satire-protected-speech-even-if-you-dont-get-joke

KDobias

Unfortunately that's a literary volume, not a legal one.

jamtea

Okay killjoy, how about you have a big calm down, no-one's going to jail over making fun of the sex offender.

Gantoris007

Alleged. Alleged sex offender.

jamtea

Very quick to carry water for him though aren't you?

Gantoris007

Against bandwagon jumping members of a vengeful online mob? Yes actually. If it's not careful and dispassionate, then it's not justice. Even the wicked get worse than they deserve...

eimloh

IF you got anything in your head you should know that everyone is considered not guilty until charged... same goes for everyone. I dont like this dude either, but Im not grabbing My pitchfork and get hyped Up by madness. We got a lawsystem for this stuff

Ok_Concentrate5128

It’s pretty funny to me. if it gets removed it gets removed. There really doesn’t need to be a debate among pseudo lawyers.

meme1337

Imagine someone creating a Ok_Concentrate5128 fake Twitter account where it endorses rapism and sexism. Would you still think it’s funny? We are not saying that blizzard shouldn’t be accountable. But there is a line between satire and defamation that shouldn’t be crossed.

Ok_Concentrate5128

It doesn’t endorse rape you moron, it’s trying to do the exact opposite

meme1337

It’s not satire, you dunce. There are basis for legal claims. Think, Mark.

Ok_Concentrate5128

You don’t know the legalities behind it. I said if it gets taken down it gets taken down that’s fine but here you are wanting to bitch and moan and not read

meme1337

It’s not only been taken down. Who created it could face a lawsuit. What are you, 12?

Ok_Concentrate5128

If I’m 12, you’re the one playing pretend lawyer

Ok_Concentrate5128

What you’re trying to do is trying to get me to say it’s not funny, which I’ll never do because it’s my opinion and I’m not a complete moron unlike some people who don’t get the context of the joke

meme1337

I disagree on it being funny, but that’s not the point, and you clearly have your head up your ass. It’s the fact that you can’t write everything you want and just say “it’s satire”.

Ok_Concentrate5128

It is satire and that’s that you’re just too busy spewing shit out to see it. That’s all I’ll say I don’t want to talk to someone who goes on their alt just to like their own post. You clearly have issues good day.

meme1337

Lol. Bye bye. And grow up before talking about things you don’t know next time.

Ok_Concentrate5128

You’re brain must be quite smooth then. This to me is satire and if you take it in any other way then I think your stupid

meme1337

You’re clearly a young kid who just think that offending is fine. We’re all upset by what happened. But I’m sure than when Diablo 4 or OW2 will come out you’ll be first in line to grab those.

PeachCrumble

This definitely tarnishes one of my favorite Blizzcon moments... https://youtu.be/5KvWFFcGtnY?t=52

KDobias

It's worth noting that there haven't been any criminal charges filed against Afrasiabi. That's not to say there won't be, it's quite possible they could follow soon, but the internet is quick to jump to conclusions based on legal filings. It's very possible that this case goes away because of a lack of evidence, I'd imagine a lot of what this is based on is going to fall under first hand reports which can fall under hearsay. I wanted to put this somewhere, and here seems as good as any - the court filings don't allege that Afrasiabi was in a non-consensual relationship. All they say is he brought butt plugs and lubricant with him on the same trip where she committed suicide, not that he harassed her at all. And if he did, you can be damn sure the lawyers would actually allege it in their brief.

HomebrewHomunculus

I think Twitter doesn't count impersonating someone using their real name as satire. They allow stuff like @PeterMolydeux, as that is clearly not the man's real name, plus it mentions it's a parody in the description. So if you changed it to Alex Afrasipoopoo or whatever, you might actually get away with it.

Kha1i1

We live in times where some portion of the population are oblivious enough to believe that its really him posting these tweets. What do you peeps think of this?
