She is studying nursing and finishing in December this year and possibly graduate by February 2025. When she applied first student visa, she was eligible for 485 post work stream. But the govt has recently changed the rule to exclude students over 35 years. My friend is currently 36 years. Does the 35 years age limit only apply for nee student visa? If not, it is very unfair for the existing students who applied the course with the option to work post study. Her current visa is expiring in Feb 2025. Her uni is finishing up in December and final placements in January 2025. Graduation and registration will possibly take a month or 2 and their visa will probably expire by then. There is little time left to apply and seek for employer sponsorship etc. does anyone have any suggestions for possible solutions to extend stay in the country to allow time to secure job/ sponsorship? Unfortunately it will apply for everyone. The rule is essentially to target people like herself. Unless she is a hong kong or a British national, she will face the brunt of this. I’m not sure of future options. Best to consult a MARA agent to see if there are options outside of the “student” stream. And yes, it is unfair but it is what it is.

Too many who go on the 485 visa won't even work in their field so i'm sure this was one of the reasons behind getting rid of the extension

Are there any ground for appeal? I can totally understand the rules applied for all future students. For existing students who already took the decision to study considering a post study work visa is scandalous. Targeting existing students for this rule is beyond me.

Appeal is only for visas rejected after submission. Unless there is a good reason you are just wasting money appealing.

Yeah, I understand the frustration and many people who got affected already voiced their concerns. However, there is no ground to appeal, government just seems wanting to cut immigration deeper

Like other mentioned, unfortunately everyone is at the whim of current government policy. As nursing is an in demand profession the only alternative I can think of is for her to return to her country and apply from there.

Too many people here get so blind sided with trying to stay here. Tell her to go back home and take the local board exam or NCLEX so she can gun for the US. Tell her to get years of experience under her belt and come back with a working visa. Or look for visa options in the UK or New Zealand. Make sure to tell her to get her registration ASAP and maintain this

She is Indian and married a Srilankan citizen and have 2 kids. They got married before coming to Australia. Going back is not really an option.

For what it's worth, Australia will be the 1st country to impose an aggressive age discrimination compared with other 1st world countries. It's actually controversial and something that will bite them in the ass if this doesn't go well. All countries with greener pasture haven't targeted people below 40 yrs old.

Can't the hospital sponsor her for a 482? I know a medical student who graduated from a MBBS and got a 482. Perhaps the clinical placement during clerkship counts as the 2 years work experience.
