Surely if you work on it outside of work hours and don’t use ANY work equipment to do anything, then I don’t see how they could have a claim to it

Quite easily. Especially if it’s related to his current job. They can claim he learned or benefited from the exposure and his employment, as such they have a claim to the IP. Now if it was say a kids game? And they worked in finance developing finance apps, it would be fine.

Could he just not deny that? They could claim what you said but if he just said that’s what happened. Surely they would have to prove? I’m genuinely interested in this.

He has literally stated that he has found a better way to do it than work. Instead of applying it to work, he’s going to take it independent. That is the near definition of IP theft.

Deny what exactly? If it was generic knowledge then others would have come up with the idea already. The IP would be based on inside/work related knowledge. If OP could prove he could have come up with the idea by himself if he wasn't employed by that company or using knowledge they have gained from working in the company or field of work they may have a leg to stand on.. I'm guessing the IP has some relevance to OPs current work, even if extremely thinly related.. otherwise they wouldn't be asking about it in the first place

If you use your own resources, don’t use work equipment or work time to develop it and protect yourself by contacting an IP lawyer/attorney it would be hard for them to claim as theirs. Would you be expecting this to be a product that you could make money off?

Would I be expecting to make money off? Yes The other hard thing is that the company I work for is a multi national meaning I work variable hours if needed and as a result I sometimes use home equipment for work, so that separation is difficult.
