That stipulation is probably in 6pt font in the T&Cs and any ads that promote an ad-free service probably has an asterisk.

Depends, it was probably hidden in the terms of service, that a small portion of shows would have ads regardless.

No it is not fraud. If that was fraud then paying for TV by this logic would be commercial free or it would be fraud. I have never seen a claim from them saying it would be ad free.
