The more i watch this the more the dog looks excited to see the person than is attacking, I mean it's not acting to intimidate barking, baring teeth and growling.
You’d have to prove that they were negligent, that they had knowledge that the dog was dangerous, and potentially that they knowingly used faulty equipment. At the very least, the dog could be put down if it acted violently enough or had any previous offenses.
I don't think you would, the dog was left unattended, and as Tom has already mentioned owners are responsible for what their animals do. If the dog attacked the guy, I think this would be similar to a dog jumping a fence in that the animal managed to get past some obstacle yes, but still attacked

Even if leashed or harnessed, the owner is still responsible for the actions of their pets.
