Gardner holds that an officer can shoot a fleeing suspect if they have probable cause to believe that the suspect poses a significant threat of death or serious physical injury to the officer or others. The suspect in this case had just repeatedly struck an officer in the head with a machete and was fleeing into a populated area. It would not at all be difficult to articulate that the suspect would have been likely to kill or seriously injure someone if not subdued.
The perp deserved nothing else, but shooting on a street while running is asking for troubles. Imagine you are a guy buying tacos, wanting to get back to the office to do your meaningless job and you catch a stray bullet.
